1. Acceptance of These Terms

By downloading, installing, or using the Aixy mobile application (“Aixy”), provided by Tunahan Aktay (“we”, “our”, or “us”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, do not use Aixy.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country if higher, to use Aixy.

3. License Grant

You may use the app for your personal use, under Apple’s Standard EULA described below. Images you create are covered by section 4. All rights not expressly granted remain with us and our licensors. These Terms supplement Apple’s Standard Licensed Application End User License Agreement. If the two conflict about your license to use the app, Apple’s agreement applies.

4. User Content

• Ownership: You retain all rights to the images and content (“User Content”) you upload.
• Processing License: You grant us, and the AI providers named in our Privacy Policy, a temporary, worldwide, royalty-free license to process your content strictly to provide AI-powered photo style and scene transformations. The license ends when the requested transformation is complete. Storage and retention, including provider service records, are described in our Privacy Policy; completion of a transformation does not guarantee immediate deletion by providers.
• Results: As between you and us, the images Aixy creates for you are yours: we claim no rights in them, and you may use them for any lawful purpose, including commercial use. If an image shows another person, you need their permission to use it.
• Responsibility: You are solely responsible for your content. Only upload photos of yourself or of people who have given you permission, and do not upload a photo of a child unless you are their parent or guardian.

5. Subscriptions & Purchases

• Subscriptions: Aixy offers optional subscription plans that unlock unlimited transformations for normal personal use and access to the full photo style catalog. Automated or abusive use is not permitted. Service availability may also be affected by provider limits.
• Legacy credits: Some existing users may retain credits from earlier versions. Those credits are separate from subscription access and are consumed when used for a transformation.
• In-App Purchases: Subscriptions are sold through Apple’s in-app purchase system. Apple handles all payments, taxes, and billing.
• Renewal & Cancellation: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple ID settings.
• Free trials: If a free trial is available on the purchase screen, its duration and the subscription price that follows are shown there. Unless you cancel at least 24 hours before the trial ends, the subscription automatically renews at the displayed price.
• Refunds: Apple handles all payments, so refunds are requested from Apple at reportaproblem.apple.com. We cannot issue refunds ourselves.

6. Prohibited Conduct

You agree not to:

• Upload or use offensive, illegal, or harmful content.
• Violate any applicable law.
• Reverse-engineer, modify, or exploit Aixy’s technology.
• Use bots or scripts to abuse the system.
• Resell, copy, or rebuild the Aixy service itself.
• Use photos of others to mock, harass, impersonate, or deceive them.

7. Intellectual Property

All content in the Aixy app (logos, code, UI, designs, text, and graphics) belongs to us or our licensors. You may not use them for commercial purposes without permission. Any feedback or suggestions you provide can be used freely by us without compensation.

8. Privacy

Your privacy is important. Please read our Privacy Policy to understand how we collect, use, and protect your data. It forms part of these Terms.

9. Disclaimers

Aixy is provided “as is” and “as available”. Aixy’s results are AI-generated transformations for creative use. They may change faces, expressions, clothing, objects, or backgrounds and may contain errors. They are not factual records of events, predictions of your appearance, or identity documents. Results may vary based on photo quality and lighting. Features and styles may change, and the AI providers Aixy relies on may be unavailable at times. History is stored only on your device, so deleting the app deletes it. Nothing in these Terms limits rights you have under mandatory consumer law.

10. Limitation of Liability

To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for Aixy in the 12 months before the claim. This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.

11. Indemnification

You are responsible for claims arising from content you upload in breach of these Terms.

12. Termination

• By You: You may stop using Aixy at any time.
• By Us: We may suspend or terminate your access if you violate these Terms or misuse the app.
• Effect: Certain clauses (User Content, Intellectual Property, Disclaimers, Liability) will survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Turkey. You agree to resolve any disputes through the courts of Turkey, unless local consumer protection laws offer you additional rights.

14. Changes to the Terms

We may update these Terms. We will announce significant changes on this page or in the app before they take effect, and update the date above.

15. Miscellaneous

These Terms, the Privacy Policy and Apple’s Standard EULA form the entire agreement between you and us. If any part is found invalid, the rest remains enforceable. You may not transfer these Terms without our permission.
